Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the TYMI AI mobile application (“App”, “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and TYMI AI (“we”, “us”, “our”), based in Romania, European Union.
2. Eligibility
· You must be at least 13 years of age to use TYMI AI.
· Users between 13 and 17 require parental or guardian consent.
· By using the App, you confirm you meet these age requirements.
3. Description of Service
TYMI AI is an AI-powered creative photo transformation service. You upload a photo of yourself and our AI system produces a creative, editorial, or cinematic artistic transformation of that image.
AI Disclosure
All images produced by TYMI AI are AI-generated creative transformations, not real photographs. They are artistic interpretations for creative and entertainment purposes only. TYMI AI does not produce, and explicitly prohibits the use of its outputs as, documentary evidence, identity verification, or any representation of factual events.
4. Acceptable Use
You agree to use TYMI AI only in accordance with these Terms. You must not:
Upload photos of other people without their explicit consent.
Upload photos containing nudity, sexual content, violence, or gore.
Upload photos of minors in any context.
Use the Service to create content that harasses, defames, or harms any individual.
Attempt to generate content depicting real public figures in misleading or defamatory contexts.
Reverse engineer, decompile, or attempt to extract the source code of the App.
Use automated tools, bots, or scripts to interact with the Service.
Circumvent any usage limits, watermarking, or subscription paywalls.
Resell or sublicense access to the Service.
5. Your Content
You retain ownership of photos you upload. By uploading, you grant us a limited, non-exclusive, royalty-free license to process your photo solely to deliver the AI transformation service you requested. This license terminates immediately upon deletion of the photo or your account.
You represent and warrant that: (a) you are the subject of or have the right to upload any photo you submit; (b) your content does not violate any third-party rights or applicable law.
Your original photos are never used to train our AI models.
6. AI-Generated Content Ownership
AI-generated images produced from your photos are owned by you, subject to these Terms. You may use them for personal, non-commercial creative purposes including social media sharing.
You may not represent AI-generated images as unaltered photographs or use them in any context that could deceive others about their artificial origin.
7. Subscriptions & Billing
TYMI AI is a subscription-based service. Access to the full feature set requires an active paid subscription. All prices are in Romanian Lei (RON).
Weekly Plan
· Free trial: 3 days at no charge (available for new subscribers only).
· First week after trial: 14.99 RON.
· Ongoing weekly rate: 24.99 RON per week, billed every 7 days.
· Renews automatically every week until cancelled.
Yearly Plan
· Annual price: 199.99 RON, billed once per year (equivalent to approximately 3.84 RON per week).
· No free trial on the yearly plan.
· Renews automatically every year until cancelled.
Billing terms applicable to all plans
· Your subscription automatically renews at the end of each billing period (weekly or yearly) unless cancelled at least 24 hours before the renewal date.
· Your Apple ID or Google account will be charged upon confirmation of purchase and at the start of each renewal period.
· You can manage and cancel your subscription at any time through your Apple ID settings (iOS) or Google Play subscriptions (Android).
· If you cancel during a free trial period, access will end immediately at the close of the trial — no charge will be made.
· The introductory first-week price of 14.99 RON applies only once per Apple ID or Google account. Subsequent weekly renewals are charged at 24.99 RON.
· All sales are final. Refunds are governed by Apple App Store and Google Play refund policies respectively.
· Prices may be converted to your local currency by Apple or Google at the time of purchase. The RON amounts above are the base prices set by TYMI AI.
8. Content Moderation
We employ automated content moderation to detect and reject requests that violate our Acceptable Use policy. Attempts to generate prohibited content may result in immediate account suspension or termination without refund.
We reserve the right to review flagged content and take appropriate action, including reporting illegal content to relevant authorities as required by law.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will meet your expectations. AI-generated results vary and are not guaranteed to be of any specific quality or style.
10. Limitation of Liability
To the maximum extent permitted by applicable law, TYMI AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any direct damages shall not exceed the amount paid by you to us in the 12 months preceding the claim.
11. Termination
You may delete your account at any time via the Profile section of the App. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your license to use the Service ceases and your data will be deleted in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of Romania and the European Union. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Romania. Nothing in these Terms limits your rights as a consumer under applicable EU law.
